These conditions govern sales made by the company PROZIO (hereinafter "PROZIO") through its website www.ozio.eu, to non-professional natural or legal persons (hereinafter the "Customer"). wishing to acquire the products offered by PROZIO. By placing his order, the Customer declares to accept the terms of these Conditions without restriction or reservation. This acceptance is in no way conditioned by a handwritten signature on the part of the Customer. In accordance with the provisions of articles 1316 to 1316-4 of the Civil Code, it is recalled that the validation of the order constitutes an electronic signature which has, between the Parties, the same value as a handwritten signature. PROZIO reserves the right to modify these GTC. The version applicable to the Customer's purchase is the one in force on the website on the date the order is placed. The products offered for sale are those presented on the site www.ozio.eu (hereinafter the “Product”). They are described and presented as precisely as possible and with the greatest possible accuracy, thus offering the Customer the possibility of knowing before the final order is taken, the essential characteristics of each product. Everything is done to guarantee maximum correspondence between the colors represented on the site and those of the real product. The photographs and graphics presented on the website www.ozio.eu are not contractual and cannot engage the responsibility of PROZIO. The Customer is required to refer to the description of each Product in order to know its properties and essential features.
In any event, in the event of non-conformity of the product delivered compared to its description on the site, the customer may either exercise his right of withdrawal or implement the guarantee of conformity of the company PROZIO which will proceed, where applicable, either on exchange or on reimbursement of the invoiced price.
The Product offers are understood within the limit of available stocks, as specified during the validation of the order as detailed below in article 5.
The Products visible on the site www.ozio.eu are available while stocks last. In the event of a debit or collection for the order of an unavailable Product, PROZIO undertakes to offer a credit or to reimburse the Customer within 30 days. PROZIO undertakes to notify by e-mail the Customer who has ordered an unavailable Product.
The Products sold on the website www.ozio.eu comply with the regulations in force in France and have performance compatible with non-professional uses.
The Products provided by PROZIO benefit from right and without additional payment,
irrespective of the right of withdrawal, in accordance with the legal provisions:
- the legal guarantee of conformity, for the Products apparently defective, damaged or damaged or not corresponding to the order,
- the legal guarantee against hidden defects resulting from a material, design or manufacturing defect affecting the delivered products and rendering them unfit for use, under the conditions and according to the procedures defined in articles L 211 of the code of consumption as well as articles L 1641 and L 1648 al 1 of the Civil Code.
In order to assert his rights, the Customer must inform PROZIO, in writing, of the non-conformity of the Products within a maximum period of twenty-four (24) months from the delivery of the Products or for the existence of hidden defects. within a maximum period of twenty-four (24) months from their discovery.
PROZIO will reimburse, replace or have repaired the Products or parts under warranty deemed to be non-compliant or defective.
Shipping costs will be reimbursed on the basis of the invoiced price and return costs will be reimbursed on presentation of supporting documents.
Refunds for Products deemed to be non-compliant or defective will be made as soon as possible and no later than thirty (30) days following the finding by PROZIO of the lack of conformity or the hidden defect.
The refund will be made by credit to the Customer's bank account or by check sent to the Customer.
The responsibility of PROZIO can not be engaged in the following cases:
- non-compliance with the legislation of the country in which the products are delivered, which it is up to the Customer to verify,
- in the event of misuse, use for professional purposes, negligence or lack of maintenance on the part of the Customer, such as in the event of normal wear and tear of the Product, accident or force majeure.
PROZIO's warranty is, in any event, limited to the replacement or reimbursement of non-compliant or defective Products.

Please clearly indicate where the part has a defect. All items must be returned in a clean, dry condition.
The prices applicable for the purchase of a Product are those which are indicated on the site when the Customer validates his order as detailed below in article 5. The prices are indicated in euros and are all understood taxes included and excluding processing and shipping costs which are billed in addition, under the conditions indicated on the website www.ozio.eu and calculated prior to placing the order.
In the event of an order to a country other than mainland France, you are the importer of the Product (s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of the company PROZIO. They will be at your expense and are your sole responsibility, both in terms of declarations and payments of any sum, tax and duties to the competent authorities and bodies in your country. We accept your orders by electronic transaction (secure server) and by bank transfer. All credit or debit card transactions will be subject to validation checks and authorized by the card issuer. If your card issuer refuses to authorize payment, we will not be liable for any delay in performance or failure to deliver your order. The fact of validating your order implies for you the obligation to pay the indicated price. The payment methods on our site are as follows: Visa, Carte bleue, MasterCard, Maestro, MasterPass, Paypal and bank transfer.
The card is only debited when the order is shipped. PROZIO uses a payment service provider and therefore never has access to confidential information relating to the Customer's means of payment.
In order to proceed with the payment, the Customer must provide his bank card number, the expiration date thereof accompanied, where applicable, by the visual cryptogram on the back of the card.
By ordering online, you confirm that the credit card belongs to you or that you are authorized by the card holder to make the payment. In case of refusal by the bank, the order will be automatically canceled and the Customer will be informed by PROZIO.
The order for product (s) will only be considered firm and final once it has been confirmed by PROZIO.
An order confirmation email will be sent to the Customer. This letter will summarize the essential elements of the Product (s) covered by the order, their price and the delivery method. PROZIO reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, an abnormal order, placed in bad faith, or a unpaid due to fraudulent use of a bank card.
The Customer will be able to follow the progress of his order via a hypertext link allowing access to an Internet page which will be communicated to him when confirming the shipment of his order.
Delivery consists of the transfer to the Customer of physical possession or control of the Product. Except in special cases or unavailability of one or more Products, the Products ordered will be delivered in one go. In the event that it is impossible to supply the Products all at once due to PROZIO, the latter will bear the costs of delivering the Products that it was unable to include in the initial delivery. PROZIO strives to ship your order the same day if it is placed before 12 noon. However, a maximum period of three (3) working days may sometimes be necessary.
The Products will be delivered to the postal address indicated by the Customer when ordering and which will appear on the delivery slip. We cannot be held responsible for any data entry errors and their consequences. In this case, the costs incurred for the return will be borne by the Customer.
Several delivery methods are available.

PROZIO undertakes to make its best efforts to deliver the products ordered by the Customer within the deadlines specified above. However, these deadlines are provided for information only.
It is possible that a package gets lost or is the victim of a delay in delivery. In the event of a delivery delay of more than 7 days, the Customer must inform Ozio's customer service by e-mail which will send the information to the Post Office to trigger the opening of an investigation. This investigation can last up to 21 days from its opening. If during this period, the package is found, it will be re-routed immediately to the place of delivery initially chosen by the Customer. If, on the other hand, the package is not found at the end of the 21-day investigation period, the Post Office considers the package as lost. In this case, Ozio will return a replacement package to the Customer, at its expense. If the lost product (s) are no longer available at this time, Ozio will reimburse the Customer for the amount of these products.
The Customer must check the apparent condition of the package and the products upon delivery or when taking their order at a collection point or in a store. The Customer must indicate, in handwritten form on the delivery slip or the document justifying taking possession of the order, any anomaly noted.
This verification is considered performed once the delivery slip signed.

You have the right to withdraw from this contract without giving any reason within fourteen (14) days. The withdrawal period expires fourteen (14) days after the day on which the Customer, or a third party other than the carrier and designated by the Customer, takes physical possession of the Product. To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by email to contact@ozio.eu. In order for the withdrawal period to be respected, it is sufficient that you send your communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.
The exchange (subject to availability) or reimbursement in the event of withdrawal will be made within fourteen (14) days of receipt by PROZIO of the Products returned by the Customer under the conditions provided for in this article.
Returns are to be made in their original condition and complete (packaging, accessories, instructions, etc.) allowing them to be re-marketed in new condition and accompanied by the purchase invoice. Damaged, soiled or incomplete Products are not taken back.
PROZIO will only reimburse the Customer for the price of the Product(s) purchased; the return costs remain the responsibility of the Customer. Reimbursement will be made using the same method of payment chosen by the customer at the time of his order.
In the event of your withdrawal from this contract and option for a refund, we will refund all payments received from you without undue delay and, in any event, no later than fourteen (14) days from the day where we received the withdrawal form accompanied by the Product as indicated below in "How to make a return?" ". We will process the refund using the same payment method you used for the initial transaction, unless you expressly agree to a different method; in any case, this reimbursement will not incur costs for you.
As of 25/11/2021, any order placed during sales or “OZIO DAYS” will be refunded in the form of a credit note.
You must return or return the Product to PROZIO without undue delay and, in any event, no later than fourteen days after you have communicated to us your decision to withdraw from this contract. This period is deemed to have been met if you return the goods before the expiry of the fourteen day period.

The shipping costs of the Product sent in exchange will be offered by PROZIO, excluding the sale item or successive exchanges (from the second) within the framework of the same order.
The products offered comply with current French legislation. The responsibility of the company PROZIO can not be engaged in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with the local authorities the possibilities of importing or using the products you plan to order.
Furthermore, PROZIO cannot be held responsible for damage resulting from improper use of the product purchased.

The language of this contract is French. These terms and conditions are subject to French law. In case of dispute, the French courts will have exclusive jurisdiction.
All disputes to which the purchase and sale transactions concluded pursuant to these GTCS could give rise, concerning their validity, interpretation, execution, termination, consequences and consequences and which could not be resolved between PROZIO and the Customer will be subject to the competent courts under the conditions of common law.

The PROZIO company reserves the right to collect nominative information and personal data concerning you. They are necessary for the management of your order, the establishment of invoices as well as the improvement of the services and information that we send you.
